Terms Of Service
SERVICES PROVIDED
Travelista Travel LLC agrees to provide travel-related services to the Client, including but not limited to: Booking transportation (flights, trains, buses, etc.). Arranging accommodations (hotels, resorts, vacation rentals, etc.). Providing recommendations for activities, tours, and excursions. Assisting with visa and travel documentation requirements. Offering travel insurance options. Providing information about travel destinations and relevant travel advice. Travelista Travel LLC shall use reasonable efforts to ensure that the services provided meet the Client’s requirements and preferences. However, the Client acknowledges that the availability, quality, and pricing of travel-related services are ultimately determined by third-party providers and may be subject to change.
FEES AND PAYMENT
The Client agrees to pay Travelista Travel LLC for their services as follows: [Specify the fee structure, e.g., a flat fee, commission-based on bookings, hourly rate, etc.]. Travelista Travel LLC shall provide the Client with an invoice detailing the fees and any additional charges incurred during the booking process. CANCELLATION AND REFUNDS
All bookings are subject to availability and confirmation by the respective travel service providers. A deposit is required to confirm all reservations. Travelista Travel LLC is not responsible for changes or cancellations made by these providers. The client is fully responsible for all charges, fees, duties, taxes, and assessments related to travel bookings made through Travelista Travel LLC. By submitting a credit card authorization to Travelista Travel LLC, you authorize the use of your payment method to purchase travel products from suppliers on your behalf. Final payments must be made by the deadline specified in your invoice or in accordance with each Suppliers terms and conditions. You understand that failure to make final payment or comply with a Suppliers purchase conditions may result in the cancellation of reservations, denial of access to flights, tours, hotels, cruises, or other travel services, and the forfeiture of any payments made. Only major credit cards are accepted for payment. You understand once a booking is confirmed and a deposit is made; refunds may not be available. Changes or cancellations to your travel plans may not qualify for a refund. All changes or cancellation requests must be submitted to Travelista Travel LLC in writing to travelistatravel.fun@gmail.com.
Air Travel
Your airline ticket constitutes a contract between you and the air carrier, even if purchased through Travelista Travel LLC. You acknowledge and agree that Travelista Travel LLC does not control the operations of independent airlines and is not liable for any personal injury, property damage, or other issues related to the purchase of your airline tickets or air travel. Due to enhanced security, it is strongly recommended that you check in at least two (2) hours prior to the scheduled departure time for domestic flights and three (3) hours for international flights. It is your responsibility to reconfirm flight times at least 24 hours prior to departure for domestic flights and 72 hours prior for international flights. Travelista Travel LLC is not liable if the airline changes fare classes, frequent flyer miles, or loyalty status. Seat assignments are not guaranteed, even after they have been assigned, and Travelista Travel LLC has no control over seat assignments.
Travel Insurance
Travelista Travel LLC highly recommends and offers access to travel insurance to protect clients against unforeseen events, such as cancellations, medical emergencies, and lost luggage. Unless specifically stated, travel insurance is not included in the cost of the client’s itinerary. By opting not to purchase travel insurance, you understand and agree that if you cancel or interrupt your travel for any reason, certain portions of your trip may not be refunded, and cancellation penalties from Travelista Travel LLC and travel suppliers may apply, potentially resulting in the loss of funds up to the full cost of your travel booking. The purchase of travel insurance is not mandatory to purchase any other product or service offered by Travelista Travel LLC. However, if you decline to purchase insurance, Travelista Travel LLC may require you to sign an insurance waiver. Travelista Travel LLC is not a licensed insurance broker and is not authorized to answer technical questions regarding benefits, exclusions, or conditions of any insurance offered, nor to evaluate the adequacy of your existing coverage. It is your responsibility to review your insurance policy to understand its coverage and to secure alternative coverage, if necessary, for conditions excluded by your policy. Travelista Travel LLC cannot guarantee that any insurance provider will approve coverage for claims under its policy and makes no representations regarding the extent of coverage provided by any insurance policy it offers. An additional charge will apply for any travel insurance purchased.
Risks and Safety
Travel to certain destinations may carry higher risks than others. Travelista Travel LLC strongly encourages clients to stay informed about current events and to review travel restrictions, warnings, announcements, and advisories issued by the United States Government before booking travel to international destinations. The Smart Traveler Enrollment Program (STEP) is a free service offered by the U.S. government for U.S. citizens traveling to or living in a foreign country. STEP allows travelers to provide details of their trip so the Department of State can assist in case of an emergency. Registration can be done at https://mytravel.state.gov/s/step. By offering travel to certain destinations, Travelista Travel LLC does not imply that travel to those destinations is advisable or without risk, and shall not be held liable for any costs, damages, or losses resulting from travel to such locations.
CLIENT RESPONSIBILITIES
The Client is responsible for all costs associated with travel, including but not limited to transportation, accommodations, meals, and activities, unless otherwise specified in this Agreement. The Client shall provide accurate and complete information to the Travelista Travel LLC, including travel preferences, passport information, and any special requirements or requests. The Client is responsible for obtaining any necessary visas, passports, and travel documents required for their trip. Travel Agent may provide assistance and guidance but is not responsible for any issues related to travel documentation. Clients are responsible for obtaining and carrying a valid passport book, necessary visas, and any other required travel documents per the regulations of their destination. Passports must be valid for at least six (6) months beyond the anticipated return date. Clients must also secure any required vaccinations or medical documentation for their travel. Non-U.S. citizens must inform Travelista Trave LLC if traveling on a non-U.S. passport. If any changes or corrections are necessary, you must contact Travelista Travel LLC immediately. If you do not notify us of the required corrections within 24 hours of receiving your travel documents, Travelista Travel LLC will not be responsible for any additional costs incurred in making the necessary corrections.
LIMITATION OF LIABILITY
Travelista Travel LLC acts solely as a booking agent for the Supplier and is not the source or provider of any travel services. You agree that Travelista Travel LLC cannot be held liable for any loss, injury, or damage resulting from any act or omission by a Supplier. Each Supplier is an independent entity with its own management and is not subject to the control of Travelista Travel LLC. The Supplier listed in your travel documentation is responsible for providing the travel services purchased, and you consent to use their services. Any alteration to an itinerary is at the sole discretion of the Supplier, and Travelista Travel LLC is not responsible for any changes. Travelista Travel LLC will not be in breach of these terms and conditions, nor liable for any failure or delay in fulfilling obligations under this agreement, if such failure or delay is caused by circumstances beyond its reasonable control. These include, but are not limited to, acts of God, accidents, riots, war, terrorist acts, epidemics, pandemics, quarantines, civil commotion, breakdown or malfunction of equipment (including web hosts and Internet service providers), destruction of or serious damage to facilities, natural disasters, governmental acts or omissions, changes in laws or regulations, national strikes, or other unforeseen events outside Travelista Travel LLC ’s control.
TERMINATION
Either party may terminate this Agreement with written notice to the other party. In the event of termination, the Client shall be responsible for any fees or charges incurred for services provided up to the termination date.
GOVERNING LAW
This Agreement shall be governed by and construed in accordance with the laws of [Specify the governing jurisdiction].
ENTIRE AGREEMENT
This Agreement constitutes the entire agreement between the Parties and supersedes any prior agreements, whether written or oral, relating to the subject matter herein.
